S0368 died in committee — fraud investigation pilot program not enacted

Senate Bill 368, which would have created a fraud investigation pilot program for Florida community associations, did not advance past the Regulated Industries Committee. The bill died on June 16, 2025, and will not become law.

What the bill proposed: S0368 would have authorized the Department of Legal Affairs to contract with a private entity to investigate economic crime, fraud, and corruption within condominium and homeowners' associations. The pilot program would have been funded through the Division of Florida Condominiums, Timeshares, and Mobile Homes Trust Fund. The division would also have been required to monitor association compliance with insurance and fidelity bonding requirements for certain persons.

What this means: No new fraud investigation authority or trust fund allocation will result from this proposal. Associations and managers should continue relying on existing enforcement mechanisms through the Division of Condominiums, local law enforcement, and civil remedies for suspected fraud or economic crimes.
